Only orders from federal, state, or your local government are allowed when determining if you qualify for the ERC based on the full or partial suspension requirement. These orders must specifically limit travel, commerce, or group meetings due to COVID-19, and they must be mandatory.

If a government merely encourages or recommends an action that impacts your business operations, then those orders would not comply with the ERC requirements. In addition, state and local government orders only count if they have jurisdiction over your business's operations.
